Festivals Toolkit: Marketing: Legal Considerations

Data Protection Act
If your booking form or evaluation form contains personal or sensitive data, these must be treated as confidential waste once the event and closing evaluation is complete. If you plan to make an audio recording, video or take photographs at the event, ensure you notify your customers and performers beforehand so they have the chance to opt out if they want to.

Remember that if you wish to use data obtained through your event as the basis for database operations for future events you should offer your audience/members an opt in facility on mailing list/membership forms. This will allow you to contact them later concerning other aspects of your work, such as fundraising, without fear of infringing some provisions of the Data Protection Act.

Further information about your legal oblications under the Data Protection Act is provided by the Information Commissioner's Office.
